Initive provides a platform for AI software providers (“Providers”) to list their AI solutions and for businesses (“Users”) to access AI software websites. Initive acts as a neutral platform and is not directly involved in any transactions between Providers and Users.
2. Eligibility
You must be at least 18 years old to use Initive. By using the platform, you represent and warrant that you have the legal right and authority to agree to these terms and conditions.
3. Account Registration
To access certain features of Initive, you may be required to create an account. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Listing AI Software
Providers may list their AI software on Initive subject to the following conditions:
- Providers must ensure that their AI software descriptions are accurate, up-to-date, and not misleading.
- Providers are responsible for delivering their products and services as described.
- Initive reserves the right to modify, reject, or remove any listings that violate these terms or are deemed inappropriate at its sole discretion.
5. Use of Initive
Users and Providers agree to use Initive only for lawful purposes. You shall not use the platform to:
- Post or distribute content that is harmful, defamatory, obscene, fraudulent, or otherwise objectionable.
- Infringe upon any intellectual property or proprietary rights of third parties.
- Engage in any activity that could damage or impair the functionality of Initive.
6. Payments
Transactions on Initive may be subject to fees as specified at the time of purchase. Payments are processed by third-party payment processors, and you agree to abide by the terms and conditions of those processors. Initive does not hold funds or process payments directly.
7. Disputes
Initive is not responsible for mediating disputes between Users and Providers. However, we may assist in resolving issues where appropriate.
8. Intellectual Property
All content, trademarks, and intellectual property rights in and on Initive are owned by Initive. Providers retain ownership of any intellectual property rights related to their software but grant Initive the right to display and promote their offerings.
9. Data and Privacy
The collection and use of your personal information are governed by the Initive’s Privacy Policy. By using Initive, you agree that we may collect and use your data in accordance with this policy.
10. Limitation of Liability
Initives provides the platform on an “as-is” basis and makes no representations or warranties regarding the accuracy or reliability of the services provided. To the fullest extent permitted by law, Initive disclaims any liability for damages arising from the use of the platform or from any transactions conducted between Users and Providers.
11. Indemnification
You agree to indemnify and hold harmless Initive, its affiliates, employees, and partners from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the platform, your violation of these terms, or any claims arising from the products or services you list.
12. Termination
Initives reserves the right to terminate or suspend your account or access to the platform at its discretion, without notice, for any reason, including violation of these terms.
13. Changes to the Terms
We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on the platform, and your continued use of the Initive following any changes constitutes your acceptance of the new terms.
